These Terms of Service (“Terms”) govern your use of the website located at https://drainawaydraintray.com (the “Site”) and the purchase of products from Drain Away LLC (“Drain Away,” “we,” “us,” or “our”). By accessing the Site or purchasing products through the Site, you agree to be bound by these Terms. If you do not agree to these Terms, you should not place orders through the Site.
Drain Away LLC operates this Site from the United States. The Site and all related services are intended for users located within the United States. Individuals under the age of 18 may use the Site, but purchases must be made with the involvement or permission of a parent or legal guardian.
Drain Away designs and sells plant drainage trays and related products intended to manage water drainage from potted plants. We make reasonable efforts to ensure that product descriptions, photographs, specifications, and pricing displayed on the Site are accurate. However, minor variations may occur due to manufacturing tolerances, lighting conditions in product photography, or screen display differences. Drain Away reserves the right to modify or discontinue products, update specifications, or correct errors in descriptions or pricing at any time without notice.
When you place an order through the Site, you are making an offer to purchase the products in your order. Drain Away reserves the right to accept or reject any order at its sole discretion, including orders that contain pricing errors, suspicious activity, or product availability issues. Orders are not considered accepted until they have been processed and shipped. After placing an order, you will receive an email confirmation summarizing the items purchased.
All prices are listed in U.S. dollars and may change without notice. Prices displayed on the Site do not include applicable sales taxes or shipping charges unless stated otherwise. Taxes and shipping costs will be calculated and displayed during checkout before the order is finalized. Drain Away reserves the right to correct pricing errors and cancel orders placed using incorrect pricing.
Payment must be received in full before an order is processed or shipped. By providing payment information, you represent that the information is accurate and that you are authorized to use the payment method provided. You also agree to pay all charges associated with your order, including taxes and shipping costs.
Drain Away will arrange shipment of products to the address provided during checkout. Shipping charges and available delivery methods will be presented during the checkout process. Delivery time estimates are provided by carriers and are not guaranteed. Drain Away is not responsible for delays caused by shipping carriers, weather conditions, supply chain disruptions, or incorrect shipping addresses provided by customers. Title and risk of loss transfer to the customer once the product is delivered to the shipping carrier.
Drain Away accepts returns under limited conditions. Return requests must be made within thirty (30) days of delivery and must include proof of purchase. Returned products must be in their original condition. To request a return authorization, customers must contact Drain Away at info@drainawaydraintray.com. Customers are responsible for return shipping costs. A twenty percent (20%) restocking fee may apply to returned items that are opened or used. Shipping costs are non-refundable. Refunds will be issued to the original payment method after the returned product is received and inspected. Drain Away reserves the right to refuse returns that do not meet the conditions outlined above.
Drain Away products are designed to collect and redirect water from potted plants and containers. Products must be used according to their intended purpose. Drain trays are not designed to prevent flooding, contain large volumes of water, or function as structural supports. Users are responsible for ensuring the product is appropriate for their specific application and that planters are placed on stable surfaces. Improper installation, modification, or misuse of the product may result in property damage or injury. Drain Away is not responsible for damages caused by misuse, improper installation, modification of the product, or use outside its intended purpose.
Drain Away provides a limited warranty covering manufacturing defects in materials or workmanship. This warranty does not cover normal wear and tear, cosmetic damage, damage caused by misuse or improper installation, or damage resulting from product modification. If a product is determined to be defective, Drain Away may repair, replace, or refund the product at its sole discretion. To the maximum extent permitted by law, Drain Away LLC will not be liable for indirect, incidental, consequential, special, or punitive damages arising from the use of the Site or the purchase or use of products. This includes but is not limited to loss of profits, property damage, or loss of use. Drain Away’s total liability for any claim relating to a purchase will not exceed the amount paid for the product giving rise to the claim.
You agree to indemnify and hold harmless Drain Away LLC from any claims, damages, liabilities, costs, or expenses resulting from misuse of products, violation of these Terms, or violation of applicable laws.
All content on the Site, including logos, product designs, images, graphics, text, and website design elements, is the property of Drain Away LLC and is protected by intellectual property laws. You may not reproduce, distribute, modify, or otherwise use Site content without prior written permission from Drain Away.
You may not use the Site for unlawful purposes, to transmit malicious code, to interfere with the operation of the Site, to attempt unauthorized access to systems, or to scrape or copy content without permission. Drain Away reserves the right to terminate or restrict access to the Site for users who violate these rules.
Your use of the Site is also governed by our Privacy Policy located at https://drainawaydraintray.com/pages/privacy-policy, which describes how personal information is collected and used.
Drain Away will not be responsible for delays or failures to perform obligations due to events beyond our reasonable control, including natural disasters, fire, war, labor disputes, government actions, supply chain disruptions, internet outages, or transportation interruptions.
Any dispute arising from these Terms or the purchase of products from the Site will first be attempted to be resolved through informal negotiation between the parties. If the dispute cannot be resolved through negotiation, it will be resolved through binding arbitration administered by the American Arbitration Association in accordance with its applicable rules. Arbitration will take place in the State of Idaho and will be conducted on an individual basis. Class actions and collective proceedings are not permitted.
These Terms are governed by the laws of the State of Idaho without regard to conflict of law principles. If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
These Terms, together with the Privacy Policy and any other policies referenced on the Site, constitute the entire agreement between you and Drain Away LLC regarding the use of the Site and the purchase of products.
